TERMS AND CONDITIONS OF SERVICE PROVISION – ASTRIC PICTURES

(OWNER: CHRISTOS DIMITRIOS PRANTZALOS)

1. INTRODUCTION

These terms and conditions govern the cooperation between the client and Astric Pictures, concerning the provision of audiovisual services such as: video production and editing, VFX, 3D animation, photography, cinematography, and other related creative work.

Acceptance of these terms is a prerequisite for the commencement of any project and is evidenced by one or more of the following: signed agreement, offer acceptance via email, payment of an advance, or any other form of project initiation.

2. OFFERS & PRICING

Offers are personalized and valid for 15 calendar days.

The final cost of each project depends on its technical requirements and complexity. Factors that may influence pricing include (indicatively):

  • The nature and complexity of the editing (subtitling, motion graphics, color grading, sound design, animation, etc.)

  • The required equipment (cameras, lenses, drones, audio gear, stabilizers, video transmission systems, etc.)

  • The quantity and difficulty of the required VFX (e.g., roto, tracking, compositing, simulations)

  • The creation of 3D renders/animations, calculated based on design, modeling, rendering time, and computational resources used

If the client requests changes that substantially alter the concept or scope of the project, the initial offer becomes void and a renegotiation of pricing and timeline is required.

3. PAYMENTS

Payment is made in two stages: an advance and the final balance. The percentage of the advance and the method of payment (invoice, receipt, or other legal document) are determined upon agreement and confirmed in writing.

No work will commence before the advance payment is made.

In case of delayed payment exceeding 15 days from the invoice date, the statutory default interest applies (Law 4152/2013).

Astric Pictures reserves the right to suspend work or delivery of the project until full payment is received.

4. DELIVERABLES & TIMELINE

The delivery schedule is agreed upon at project initiation and depends on the timely provision of materials, approvals, and payments by the client.

Delays on the client’s part may significantly impact the agreed delivery dates.

Timelines are indicative and subject to adjustments due to unforeseen technical, artistic, or external factors.

5. REVISIONS / CHANGES

Up to two (2) rounds of revisions are included on the first deliverable of the project (audiovisual product in digital format).

Any subsequent changes or interventions beyond the agreed specifications may incur additional charges, upon prior notice to the client.

The implementation time for such changes is determined at the discretion of Astric Pictures, based on the nature of the requests and workload availability.

A "revision" is considered any minor or moderate modification to the existing deliverable, without altering the overall concept or style of the project.

6. FILE STORAGE

Final deliverables are retained by Astric Pictures for up to six (6) months from the delivery date.

After this period, the responsibility for archiving belongs to the client.

Re-sending or restoring files beyond this period is only possible if they still exist in the archive system and may be subject to an extra charge.

7. COPYRIGHT

Astric Pictures retains the right to use the final project (or portions of it) for purposes of promotion, advertising, or presentation (portfolio, social media, website, etc.), unless explicitly agreed otherwise prior to project initiation.

The client acquires, upon full payment, a non-exclusive license to use the final deliverable for the specific, pre-agreed purpose.

Delivery of original project files (raw footage, project files, scene files, layered graphics, etc.) is not included in the base price and requires prior agreement and additional compensation, as it constitutes indirect transfer of intellectual property rights.

All audiovisual works produced are protected under the Greek copyright law (Law 2121/1993).

8. CANCELLATIONS

In case of project cancellation by the client, the advance payment is non-refundable.

If work exceeding the value of the advance has already been completed, an additional charge may be required depending on the degree of completion.

Astric Pictures reserves the right to cancel cooperation for serious reasons or due to force majeure, returning any payments corresponding to unproduced work.

9. LIMITATION OF LIABILITY

Astric Pictures is not liable for delays caused by factors beyond its control, such as: delayed delivery of material by the client, late payments, technical failures, power outages, or third-party service disruptions.

Astric Pictures makes every reasonable effort to ensure timely and high-quality project completion.

Under no circumstances shall it be held liable for direct or indirect financial damages, loss of profits, or harm to professional reputation resulting from delays or non-delivery of the project.

10. JURISDICTION & DISPUTE RESOLUTION

These terms and conditions are governed by Greek law.

The parties (natural or legal persons) shall make every reasonable effort to resolve any dispute arising from their cooperation amicably.

If this proves impossible, the parties may seek mediation or any other lawful means of dispute resolution, in accordance with applicable legislation.

1. ΕΙΣΑΓΩΓΗ

ΟΙ ΠΑΡΟΝΤΕΣ ΟΡΟΙ ΚΑΙ ΠΡΟΥΠΟΘΕΣΕΙΣ ΡΥΘΜΙΖΟΥΝ ΤΗ ΣΥΝΕΡΓΑΣΙΑ ΜΕΤΑΞΥ ΤΟΥ ΠΕΛΑΤΗ ΚΑΙ ΤΗΣ ASTRIC PICTURES, ΣΧΕΤΙΚΑ ΜΕ ΤΗΝ ΠΑΡΟΧΗ ΟΠΤΙΚΟΑΚΟΥΣΤΙΚΩΝ ΥΠΗΡΕΣΙΩΝ, ΟΠΩΣ: ΠΑΡΑΓΩΓΗ ΚΑΙ ΕΠΕΞΕΡΓΑΣΙΑ ΒΙΝΤΕΟ, VFX, 3D ANIMATION, ΦΩΤΟΓΡΑΦΙΣΗ, ΚΙΝΗΜΑΤΟΓΡΑΦΗΣΗ ΚΑΙ ΑΛΛΕΣ ΣΥΝΑΦΕΙΣ ΔΗΜΙΟΥΡΓΙΚΕΣ ΕΡΓΑΣΙΕΣ.

Η ΑΠΟΔΟΧΗ ΤΩΝ ΠΑΡΟΝΤΩΝ ΟΡΩΝ ΑΠΟΤΕΛΕΙ ΠΡΟΫΠΟΘΕΣΗ ΓΙΑ ΤΗΝ ΕΝΑΡΞΗ ΟΠΟΙΑΣΔΗΠΟΤΕ ΕΡΓΑΣΙΑΣ ΚΑΙ ΤΕΚΜΗΡΙΩΝΕΤΑΙ ΜΕ ΕΝΑΝ Ή ΠΕΡΙΣΣΟΤΕΡΟΥΣ ΑΠΟ ΤΟΥΣ ΑΚΟΛΟΥΘΟΥΣ ΤΡΟΠΟΥΣ: ΥΠΟΓΕΓΡΑΜΜΕΝΗ ΣΥΜΦΩΝΙΑ, ΑΠΟΔΟΧΗ ΠΡΟΣΦΟΡΑΣ ΜΕΣΩ EMAIL, ΠΛΗΡΩΜΗ ΠΡΟΚΑΤΑΒΟΛΗΣ Ή ΟΠΟΙΑΔΗΠΟΤΕ ΑΛΛΗ ΜΟΡΦΗ ΕΝΑΡΞΗΣ ΤΟΥ ΕΡΓΟΥ.

2. ΠΡΟΣΦΟΡΕΣ & ΤΙΜΟΛΟΓΗΣΗ

  • ΟΙ ΠΡΟΣΦΟΡΕΣ ΠΟΥ ΑΠΟΣΤΕΛΛΟΝΤΑΙ ΕΙΝΑΙ ΠΡΟΣΩΠΟΠΟΙΗΜΕΝΕΣ ΚΑΙ ΙΣΧΥΟΥΝ ΓΙΑ 15 ΗΜΕΡΟΛΟΓΙΑΚΕΣ ΗΜΕΡΕΣ.

  • ΤΟ ΤΕΛΙΚΟ ΚΟΣΤΟΣ ΚΑΘΕ ΕΡΓΟΥ ΕΞΑΡΤΑΤΑΙ ΑΠΟ ΤΙΣ ΤΕΧΝΙΚΕΣ ΑΠΑΙΤΗΣΕΙΣ ΚΑΙ ΤΗΝ ΠΟΛΥΠΛΟΚΟΤΗΤΑ. ΠΑΡΑΓΟΝΤΕΣ ΠΟΥ ΕΝΔΕΧΕΤΑΙ ΝΑ ΕΠΙΔΡΑΣΟΥΝ ΣΤΗ ΧΡΕΩΣΗ ΠΕΡΙΛΑΜΒΑΝΟΥΝ (ΕΝΔΕΙΚΤΙΚΑ):

    • ΤΗ ΦΥΣΗ ΚΑΙ ΠΟΛΥΠΛΟΚΟΤΗΤΑ ΤΟΥ ΜΟΝΤΑΖ (ΥΠΟΤΙΤΛΙΣΜΟΣ, MOTION GRAPHICS, COLOR GRADING, ΗΧΗΤΙΚΟΣ ΣΧΕΔΙΑΣΜΟΣ, ANIMATION Κ.ΛΠ.).

    • ΤΟΝ ΕΞΟΠΛΙΣΜΟ ΠΟΥ ΘΑ ΑΠΑΙΤΗΘΕΙ (ΚΑΜΕΡΕΣ, ΦΑΚΟΙ, DRONES, AUDIO GEAR, ΣΥΣΤΗΜΑΤΑ ΣΤΑΘΕΡΟΠΟΙΗΣΗΣ, ΣΥΣΤΗΜΑΤΑ VIDEO TRANSMISSION Κ.Α.).

    • ΤΟΝ ΑΡΙΘΜΟ ΚΑΙ ΤΗ ΔΥΣΚΟΛΙΑ ΤΩΝ ΑΠΑΙΤΟΥΜΕΝΩΝ VFX (Π.Χ. ROTO, TRACKING, COMPOSITING, SIMULATIONS).

    • ΤΗ ΔΗΜΙΟΥΡΓΙΑ 3D RENDERS / ANIMATIONS, ΠΟΥ ΥΠΟΛΟΓΙΖΕΤΑΙ ΒΑΣΕΙ ΣΧΕΔΙΑΣΜΟΥ, MODELING, RENDERING TIME ΚΑΙ ΧΡΗΣΗΣ ΥΠΟΛΟΓΙΣΤΙΚΩΝ ΠΟΡΩΝ.

  • ΣΕ ΠΕΡΙΠΤΩΣΗ ΠΟΥ Ο ΠΕΛΑΤΗΣ ΖΗΤΗΣΕΙ ΑΛΛΑΓΕΣ ΠΟΥ ΜΕΤΑΒΑΛΛΟΥΝ ΟΥΣΙΩΔΩΣ ΤΟ CONCEPT Ή ΤΗΝ ΕΚΤΑΣΗ ΤΟΥ ΕΡΓΟΥ, Η ΑΡΧΙΚΗ ΠΡΟΣΦΟΡΑ ΠΑΥΕΙ ΝΑ ΙΣΧΥΕΙ ΚΑΙ ΑΠΑΙΤΕΙΤΑΙ ΕΠΑΝΑΔΙΑΠΡΑΓΜΑΤΕΥΣΗ ΤΙΜΗΣ ΚΑΙ ΧΡΟΝΟΔΙΑΓΡΑΜΜΑΤΟΣ.

3. ΠΛΗΡΩΜΕΣ

  • Η ΠΛΗΡΩΜΗ ΠΡΑΓΜΑΤΟΠΟΙΕΙΤΑΙ ΣΕ ΔΥΟ ΣΤΑΔΙΑ: ΠΡΟΚΑΤΑΒΟΛΗ ΚΑΙ ΕΞΟΦΛΗΣΗ. ΤΟ ΠΟΣΟΣΤΟ ΤΗΣ ΠΡΟΚΑΤΑΒΟΛΗΣ ΚΑΙ Ο ΤΡΟΠΟΣ ΠΛΗΡΩΜΗΣ (ΤΙΜΟΛΟΓΙΟ, ΑΠΟΔΕΙΞΗ Ή ΑΛΛΟ ΝΟΜΙΜΟ ΠΑΡΑΣΤΑΤΙΚΟ) ΚΑΘΟΡΙΖΟΝΤΑΙ ΚΑΤΟΠΙΝ ΣΥΝΕΝΝΟΗΣΗΣ ΚΑΙ ΕΠΙΒΕΒΑΙΩΝΟΝΤΑΙ ΓΡΑΠΤΩΣ.

  • ΟΠΟΙΑΔΗΠΟΤΕ ΕΡΓΑΣΙΑ ΞΕΚΙΝΑ ΜΟΝΟ ΜΕΤΑ ΤΗΝ ΚΑΤΑΒΟΛΗ ΤΗΣ ΠΡΟΚΑΤΑΒΟΛΗΣ.

  • ΣΕ ΠΕΡΙΠΤΩΣΗ ΚΑΘΥΣΤΕΡΗΣΗΣ ΠΛΗΡΩΜΗΣ ΠΕΡΑΝ ΤΩΝ 15 ΗΜΕΡΩΝ ΑΠΟ ΤΗΝ ΕΚΔΟΣΗ ΠΑΡΑΣΤΑΤΙΚΟΥ, ΕΠΙΒΑΛΛΕΤΑΙ ΝΟΜΙΜΟΣ ΤΟΚΟΣ ΥΠΕΡΗΜΕΡΙΑΣ (Ν. 4152/2013).

  • Η ASTRIC PICTURES ΔΙΑΤΗΡΕΙ ΤΟ ΔΙΚΑΙΩΜΑ ΑΝΑΣΤΟΛΗΣ ΕΡΓΑΣΙΩΝ Ή ΠΑΡΑΔΟΣΗΣ ΕΡΓΟΥ ΕΩΣ ΤΗΝ ΠΛΗΡΗ ΕΞΟΦΛΗΣΗ ΤΩΝ ΣΥΜΦΩΝΗΘΕΝΤΩΝ ΠΟΣΩΝ.

4. ΠΑΡΑΔΟΣΕΙΣ & ΧΡΟΝΟΔΙΑΓΡΑΜΜΑ

  • ΤΟ ΧΡΟΝΟΔΙΑΓΡΑΜΜΑ ΠΑΡΑΔΟΣΗΣ ΣΥΜΦΩΝΕΙΤΑΙ ΚΑΤΑ ΤΗΝ ΕΝΑΡΞΗ ΤΟΥ ΕΡΓΟΥ ΚΑΙ ΒΑΣΙΖΕΤΑΙ ΣΤΗΝ ΕΓΚΑΙΡΗ ΠΑΡΟΧΗ ΥΛΙΚΟΥ, ΕΓΚΡΙΣΕΩΝ ΚΑΙ ΠΛΗΡΩΜΩΝ ΑΠΟ ΤΗΝ ΠΛΕΥΡΑ ΤΟΥ ΠΕΛΑΤΗ.

  • ΚΑΘΥΣΤΕΡΗΣΕΙΣ ΑΠΟ ΠΛΕΥΡΑΣ ΤΟΥ ΠΕΛΑΤΗ ΕΝΔΕΧΕΤΑΙ ΝΑ ΕΠΗΡΕΑΣΟΥΝ ΣΗΜΑΝΤΙΚΑ ΤΙΣ ΗΜΕΡΟΜΗΝΙΕΣ ΠΑΡΑΔΟΣΗΣ.

  • ΤΑ ΧΡΟΝΟΔΙΑΓΡΑΜΜΑΤΑ ΕΙΝΑΙ ΕΝΔΕΙΚΤΙΚΑ ΚΑΙ ΥΠΟΚΕΙΝΤΑΙ ΣΕ ΑΝΑΠΡΟΣΑΡΜΟΓΗ ΣΕ ΠΕΡΙΠΤΩΣΗ ΑΠΡΟΒΛΕΠΤΩΝ ΤΕΧΝΙΚΩΝ, ΚΑΛΛΙΤΕΧΝΙΚΩΝ Ή ΕΞΩΤΕΡΙΚΩΝ ΠΑΡΑΓΟΝΤΩΝ.

5. ΔΙΟΡΘΩΣΕΙΣ / ΑΛΛΑΓΕΣ

  • ΠΕΡΙΛΑΜΒΑΝΟΝΤΑΙ ΕΩΣ ΔΥΟ (2) ΚΥΚΛΟΙ ΔΙΟΡΘΩΣΕΩΝ ΕΠΙ ΤΟΥ ΠΡΩΤΟΥ ΠΑΡΑΔΟΤΕΟΥ ΤΟΥ ΕΡΓΟΥ (ΟΠΤΙΚΟΑΚΟΥΣΤΙΚΟ ΠΡΟΪΟΝ ΣΕ ΨΗΦΙΑΚΗ ΜΟΡΦΗ).

  • ΜΕΤΑΓΕΝΕΣΤΕΡΕΣ ΑΛΛΑΓΕΣ Ή ΠΑΡΕΜΒΑΣΕΙΣ ΠΟΥ ΥΠΕΡΒΑΙΝΟΥΝ ΤΙΣ ΣΥΜΦΩΝΗΘΕΙΣΕΣ ΠΡΟΔΙΑΓΡΑΦΕΣ ΕΝΔΕΧΕΤΑΙ ΝΑ ΧΡΕΩΝΟΝΤΑΙ ΕΠΙΠΛΕΟΝ, ΚΑΤΟΠΙΝ ΕΝΗΜΕΡΩΣΗΣ ΤΟΥ ΠΕΛΑΤΗ.

  • Η ΧΡΟΝΙΚΗ ΔΙΑΡΚΕΙΑ ΥΛΟΠΟΙΗΣΗΣ ΤΩΝ ΑΛΛΑΓΩΝ ΚΑΘΟΡΙΖΕΤΑΙ ΚΑΤΑ ΤΗΝ ΚΡΙΣΗ ΤΗΣ ASTRIC PICTURES, ΒΑΣΕΙ ΤΟΥ ΠΕΡΙΕΧΟΜΕΝΟΥ ΤΩΝ ΑΙΤΗΜΑΤΩΝ ΚΑΙ ΤΗΣ ΔΙΑΘΕΣΙΜΟΤΗΤΑΣ.

  • ΩΣ «ΔΙΟΡΘΩΣΗ» ΝΟΕΙΤΑΙ ΚΑΘΕ ΜΙΚΡΗΣ Ή ΜΕΣΑΙΑΣ ΚΛΙΜΑΚΑΣ ΤΡΟΠΟΠΟΙΗΣΗ ΤΟΥ ΥΠΑΡΧΟΝΤΟΣ ΠΑΡΑΔΟΤΕΟΥ, ΧΩΡΙΣ ΑΛΛΑΓΗ ΤΟΥ ΣΥΝΟΛΙΚΟΥ CONCEPT Ή ΥΦΟΥΣ ΤΟΥ ΕΡΓΟΥ.

6. ΑΠΟΘΗΚΕΥΣΗ ΑΡΧΕΙΩΝ

  • ΤΑ ΤΕΛΙΚΑ ΠΑΡΑΔΟΤΕΑ ΑΡΧΕΙΑ ΤΗΡΟΥΝΤΑΙ ΑΠΟ ΤΗΝ ASTRIC PICTURES ΓΙΑ ΔΙΑΣΤΗΜΑ ΕΩΣ ΕΞΙ (6) ΜΗΝΕΣ ΑΠΟ ΤΗΝ ΗΜΕΡΟΜΗΝΙΑ ΠΑΡΑΔΟΣΗΣ.

  • ΜΕΤΑ ΤΗΝ ΠΑΡΟΔΟ ΤΟΥ ΔΙΑΣΤΗΜΑΤΟΣ ΑΥΤΟΥ, Η ΕΥΘΥΝΗ ΦΥΛΑΞΗΣ ΤΩΝ ΑΡΧΕΙΩΝ ΑΝΗΚΕΙ ΣΤΟΝ ΠΕΛΑΤΗ.

  • Η ΕΚ ΝΕΟΥ ΠΑΡΑΧΩΡΗΣΗ Ή ΕΠΑΝΑΦΟΡΑ ΑΡΧΕΙΩΝ ΠΕΡΑΝ ΤΟΥ ΠΡΟΑΝΑΦΕΡΟΜΕΝΟΥ ΔΙΑΣΤΗΜΑΤΟΣ ΕΙΝΑΙ ΔΥΝΑΤΗ ΜΟΝΟ ΕΦΟΣΟΝ ΥΦΙΣΤΑΝΤΑΙ ΣΤΟ ΑΡΧΕΙΑΚΟ ΣΥΣΤΗΜΑ ΚΑΙ ΜΠΟΡΕΙ ΝΑ ΕΠΙΦΕΡΕΙ ΠΡΟΣΘΕΤΗ ΧΡΕΩΣΗ.

7. ΠΝΕΥΜΑΤΙΚΑ ΔΙΚΑΙΩΜΑΤΑ

  • Η ASTRIC PICTURES ΔΙΑΤΗΡΕΙ ΤΟ ΔΙΚΑΙΩΜΑ ΧΡΗΣΗΣ ΤΟΥ ΤΕΛΙΚΟΥ ΕΡΓΟΥ (Η ΤΜΗΜΑΤΩΝ ΤΟΥ) ΓΙΑ ΣΚΟΠΟΥΣ ΠΡΟΩΘΗΣΗΣ, ΔΙΑΦΗΜΙΣΗΣ Ή ΠΑΡΟΥΣΙΑΣΗΣ (PORTFOLIO, SOCIAL MEDIA, ΙΣΤΟΣΕΛΙΔΑ Κ.ΛΠ.), ΕΚΤΟΣ ΕΑΝ ΕΧΕΙ ΣΥΜΦΩΝΗΘΕΙ ΡΗΤΩΣ ΤΟ ΑΝΤΙΘΕΤΟ ΠΡΙΝ ΤΗΝ ΕΝΑΡΞΗ ΤΟΥ ΕΡΓΟΥ.

  • Ο ΠΕΛΑΤΗΣ ΑΠΟΚΤΑ, ΜΕΤΑ ΤΗΝ ΠΛΗΡΗ ΕΞΟΦΛΗΣΗ, ΜΗ ΑΠΟΚΛΕΙΣΤΙΚΗ ΑΔΕΙΑ ΧΡΗΣΗΣ ΤΟΥ ΤΕΛΙΚΟΥ ΠΑΡΑΔΟΤΕΟΥ ΓΙΑ ΤΟΝ ΣΚΟΠΟ ΠΟΥ ΕΧΕΙ ΠΡΟΚΑΘΟΡΙΣΤΕΙ ΚΑΙ ΣΥΜΦΩΝΗΘΕΙ.

  • Η ΠΑΡΑΔΟΣΗ ΤΩΝ ΠΡΩΤΟΓΕΝΩΝ ΑΡΧΕΙΩΝ (RAW FOOTAGE, PROJECT FILES, SCENE FILES, LAYERED GRAPHICS Κ.Α.) ΔΕΝ ΠΕΡΙΛΑΜΒΑΝΕΤΑΙ ΣΤΗΝ ΑΡΧΙΚΗ ΤΙΜΗ ΚΑΙ ΠΡΟΫΠΟΘΕΤΕΙ ΠΡΟΗΓΟΥΜΕΝΗ ΣΥΜΦΩΝΙΑ ΚΑΙ ΕΠΙΠΛΕΟΝ ΧΡΕΩΣΗ, ΚΑΘΩΣ ΣΥΝΙΣΤΑ ΕΜΜΕΣΗ ΠΑΡΑΧΩΡΗΣΗ ΠΝΕΥΜΑΤΙΚΩΝ ΔΙΚΑΙΩΜΑΤΩΝ.

  • ΟΛΑ ΤΑ ΠΑΡΑΓΟΜΕΝΑ ΟΠΤΙΚΟΑΚΟΥΣΤΙΚΑ ΕΡΓΑ ΥΠΟΚΕΙΝΤΑΙ ΣΤΗΝ ΠΡΟΣΤΑΣΙΑ ΤΟΥ ΝΟΜΟΥ ΠΕΡΙ ΠΝΕΥΜΑΤΙΚΗΣ ΙΔΙΟΚΤΗΣΙΑΣ (Ν. 2121/1993).

8. ΑΚΥΡΩΣΕΙΣ

  • ΣΕ ΠΕΡΙΠΤΩΣΗ ΑΚΥΡΩΣΗΣ ΤΟΥ ΕΡΓΟΥ ΑΠΟ ΤΟΝ ΠΕΛΑΤΗ, Η ΚΑΤΑΒΛΗΘΕΙΣΑ ΠΡΟΚΑΤΑΒΟΛΗ ΔΕΝ ΕΠΙΣΤΡΕΦΕΤΑΙ.
